Terms & Conditions
Standard Terms and Conditions of Sale and Service. Effective upon requesting, authorizing, or paying for any estimate, service, repair, or installation.
True Service, Infinite Care
By requesting, authorizing, or paying for any estimate, service, repair, or installation performed by TruFinity Plumbing Heating & Cooling (the “Contractor”), the property owner, tenant, or authorized agent (the “Customer”) agrees that these Standard Terms & Conditions govern the transaction in full, together with any written estimate, work order, or invoice issued by the Contractor (collectively the “Agreement”).
1. Definitions
- Invoice — The final statement of account issued upon completion of work.
- Net Due — The calendar date on which the entire outstanding balance becomes payable in full.
- Workmanship — All labour, installation practices, fastening, piping, wiring, and venting performed by the Contractor or its authorized subcontractors.
- Critical Component — For “No-Lemon” purposes, a furnace/air-handler heat exchanger, compressor, or tankless water-heater heat exchanger.
2. The TruFinity Promise
Every service, repair, and installation performed by TruFinity carries the warranties in 2.2 and the guarantees in 2.3. The rules in 2.1 apply to every one of them.
2.1 Rules for Every Warranty and Guarantee
- Transfer — Warranties in 2.2 transfer once free within 3 years of the invoice date, then for a CA $49 admin fee, and only if required maintenance is current. The Lifetime Workmanship Guarantee and the guarantees in 2.3 stay with the original Customer. Memberships transfer under Section 7.8.
- No Stacking — Where more than one term applies to the same work (membership, option, standalone item, or standard term), the single longest applies; a package never reduces coverage. A term is set on the invoice date and holds while required maintenance is kept up, even if a membership ends.
- Payment, Maintenance and Registration — Coverage starts once the invoice is paid in full. Maintenance stated on the estimate is done yearly by TruFinity (membership or paid visit; membership never required). If required maintenance is more than 60 days past due, TruFinity coverage is suspended until the maintenance is done; the term keeps running and manufacturer warranties are unaffected. TruFinity registers every unit it installs where required.
- Exclusions — No coverage for damage caused by abuse, neglect, improper use, power surges, fire, flood, lightning, or other force majeure events; pre-existing concealed conditions or building/system conditions outside the quoted scope (e.g., collapsed ducts, insufficient insulation); or modifications or repairs performed by others.
- Claim Process — Customer must notify TruFinity within 72 hours of discovering an issue and allow reasonable access for diagnosis. TruFinity will coordinate OEM part claims.
- Warranty Calls — $0 when the failure is covered; the dispatch/diagnostic fee applies when it is not, and on every call after regular business hours. Covered parts and labour stay free; labour is billed at regular rates.
- Remedy and Liability — TruFinity’s sole obligation is to repair, replace, credit, or refund as specified; consequential or incidental damages are not recoverable. On installations, liability is limited to the lesser of replacement cost or contract price.
2.2 Warranties
| Warranty | Coverage | Conditions |
|---|---|---|
| Lifetime Workmanship Guarantee | Workmanship that fails on any service, repair, or installation by TruFinity — including piping, brazing, venting, duct transitions, wiring, fastening, and condensate management — is fixed free, for as long as you own the home and the work stays in place. | Covers TruFinity workmanship only, never product failure. Excludes manufacturer parts, consumables (e.g., filters, UV lamps), normal wear, misuse, acts of God, and alterations by others. TruFinity diagnoses the cause and must be given the chance to correct the workmanship before any refund. Not transferable. |
| Parts & Labour Warranty | If a part TruFinity installed or replaced fails during the term, TruFinity replaces it and covers the labour. The term is the one stated on the estimate and invoice for the option and category chosen (repairs, plumbing replacements, repipes, HVAC equipment, tankless, water treatment, indoor air quality). A standalone item carries the base term for its category. Band-Aid work covers the replaced part or repaired section only. TruLoyalty+ members get at least 3 years on repairs. One no-charge return visit per covered failure. | Any maintenance requirement stated on the estimate applies. Runs concurrently with the manufacturer parts warranty; after the TruFinity term, labour on parts still under manufacturer warranty is billed at standard rates. Excludes parts not installed or replaced by TruFinity; consumables (filters, cartridges, media pads, UV bulbs, ionizer cells, anode rods); water, property, consequential, or indirect damage; neglect, misuse, freezing, power surges, acts of nature, poor water quality; customer-supplied parts; and pre-existing conditions of plumbing, drains, venting, ductwork, or electrical. |
| Manufacturer Warranty | Passed through on every option: parts only, on the manufacturer’s terms. TruFinity never promises more than the manufacturer. | Labour, shipping, and freight are excluded unless the manufacturer states otherwise. Requires installation to code and the maintenance the manufacturer specifies. TruFinity registers every unit it installs where registration is required. |
| Drain Warranty | Coverage level by the option chosen, as stated on the estimate and invoice. No warranty without a camera inspection; the longest levels also require the line to be hydro-jetted. One free re-clear per warranty period; further visits at the standard rate. | Applies to the line cleared and inspected on that visit, with the camera footage recorded on the job. No warranty if the camera is declined or shows damage, root intrusion, or other defects; a written repair or lining quote is provided instead. Excludes re-blockage from foreign objects, grease, wipes, or chemical misuse; collapsed, broken, offset, or bellied pipe; and work by others. |
| TruProtect Cable Coverage | If TruFinity’s drain cable becomes lodged or breaks in the line during a TruFinity service, TruFinity pays the cost of retrieval and the additional work needed to resolve it, up to the recovery limit of the level purchased, as stated on the estimate and invoice. One claim per job. Higher levels include the access, pipe repair, excavation, and site restoration stated for that level, within the limit. | The limit is per event and is the most TruFinity pays; it is not reduced or replaced by the contract price. Applies to conditions inside the pipe that were not known before the service. Notify TruFinity within 72 hours, as in Section 2.1, and allow access. No coverage for pre-existing damage the camera shows, a camera inspection the customer declined, foreign objects, or work by others. Declined coverage is recorded on the job. |
2.3 Guarantees
| Guarantee | Coverage | Conditions |
|---|---|---|
| Price Lock Guarantee | The quoted price is the final price, with no upsells, hidden charges, or surprises. Valid 30 days from the quote date. | Hidden, code-related, or safety hazards found after work begins (e.g., asbestos, non-compliant venting) are quoted separately and need written approval. Customer-requested scope changes void the lock for the added work only. After 30 days, material surcharges may apply with approval. Tax changes and new municipal permit fees are excluded. |
| Satisfaction Guarantee | New comfort systems (tankless, furnaces, air conditioners, heat pumps): if not completely satisfied within 6 months, TruFinity removes the equipment and refunds 100% of the purchase price, or credits it toward a replacement system. Upgrades: Customer pays the difference; downgrades: TruFinity refunds it. | Written request within 6 months of installation. System operated and maintained as recommended. TruFinity must be allowed to diagnose and resolve concerns first. Covers only the original system’s equipment and labour; excludes unrelated work, misuse, pre-existing home conditions, and consequential costs such as drywall or cosmetic repairs. A credit toward a replacement is the one offer on that replacement and is not combined with a promotion. |
| No-Lemon Guarantee | One critical failure of a compressor (5 years or less) or primary heat exchanger (10 years or less) triggers system replacement, like-for-like in efficiency and capacity. | Annual maintenance by TruFinity. Customer may pay the difference to upgrade. Maximum liability is the original contract price. Void if recommended repairs (e.g., surge protector) are declined and a related failure follows. |
| No-Heat / No-Cool Guarantee | Total loss of heating (below 5°C outdoor) or cooling (above 30°C outdoor) in the first 12 months after startup: fixed within 24 hours of the first logged request, or a hotel up to CA $250 per night, maximum two nights, within 25 km, one room. | Void if the homeowner refuses recommended interim solutions (e.g., space heaters, temporary AC). Addresses more than 50 km from TruFinity’s base receive the earliest possible dispatch plus a CA $100 comfort credit instead of a hotel. |
| Repair Credit Guarantee | Replace an appliance within 90 days of a paid repair on it, and 100% of those repair costs are credited toward a TruFinity-supplied replacement, up to $2,000. | Only repairs performed and invoiced by TruFinity qualify. Excludes diagnostic fees, maintenance, memberships, and third-party work. Replacement equipment carries the standard warranties and manufacturer warranty. The credit is the one offer on the replacement and is not combined with a promotion. |
| Lowest Price Guarantee | A lower qualifying competitor quote within 30 days after install: TruFinity refunds the difference, one refund claim per installation, up to CA $1,500, paid within 10 business days to the original payment method. | Quote dated within 14 days, itemizing identical model numbers, accessories, permits, and warranty terms, from a licensed, bonded, and insured contractor within 50 km. Excludes clearance, liquidation, DIY, government-subsidized, or going-out-of-business pricing. |
3. Manufacturer Warranty Administration — Non-TruFinity Equipment or Expired Coverage
TruFinity may assist with warranty claims on equipment not supplied or installed by us, or where our warranty has expired or been voided.
A non-refundable Manufacturer Warranty Administration Fee of CA $129 will apply. This covers administrative effort in liaising with manufacturers, diagnostic labour to verify the fault, and documentation and follow-up required for claim submission.
If equipment or parts were not installed by TruFinity: the Customer is responsible for full upfront payment. Once the manufacturer warranty claim is approved, TruFinity will reimburse the Customer for the covered amount, less the Manufacturer Warranty Administration Fee.
Any reimbursement received from the manufacturer for an amount already charged to the Customer will be credited to the Customer’s account. TruFinity will not retain payment for administration or labour that has been reimbursed by the manufacturer or supplier.
TruFinity cannot guarantee manufacturer approval of claims or coverage of labour costs. Declined warranty items will be quoted and billed separately at standard rates.
Warranty services are scheduled during regular business hours. After-hours or emergency service requests carry the dispatch/diagnostic fee; labour is billed at regular rates.
4. Standard Exclusions (All Quotes)
The following items are excluded from base pricing unless otherwise stated in writing. Work may be performed under a separate change order at additional cost.
| Category | Excluded |
|---|---|
| Property and structural | Drywall repair and painting, plaster, wallpaper, trim removal/replacement beyond minimal access cuts. Belly tarp replacement or repair for a mobile home. Flooring or finished-surface restoration (tile, carpet, hardwood). Cabinetry, countertops, millwork modifications or refinishing. Masonry or concrete cutting/patching beyond penetrations. Roofing or siding repairs outside the immediate weather-seal of new penetrations. |
| Exterior and site | Landscaping, sod, shrubs, or irrigation restoration. Paving stone or concrete-slab re-laying. Fence or deck removal/re-installation. |
| Building services and utilities | Electrical panel upgrades, new circuits, or permits beyond listed disconnect/whip/breaker. Gas meter upsizing or utility valve relocation. Whole-home ventilation or duct balancing outside the work area. Water-treatment solutions for iron, hardness, or bacteria. |
| Codes, permits and inspections | Correction of pre-existing code violations not disclosed at the time of the quote. Re-inspection fees triggered by Customer-requested scope changes. Heritage, strata, or architectural review costs. |
| Hidden / unforeseen conditions | Mould, rotten framing, buried lines, rock excavation, or similar concealed hazards. Work is paused; a written change order will be issued before proceeding. Asbestos testing is not included. For properties built prior to 1990, any suspected asbestos-containing materials must be tested and cleared by a certified third party before work can continue. |
| Surge damage, consumables, and aesthetics | Warranty is void on all electrical components within any equipment installed by TruFinity if failure or damage is caused by a power surge. Warranties do not cover consumables and wear items such as filters, cartridges, media pads, UV bulbs, ionizer cells, anode rods, water panels, batteries, or refrigerant lost due to owner damage. Interior paint colour matching, texture blending, acoustic solutions beyond manufacturer specifications, or exact grille/register style replacement when discontinued. |
5. Payment Terms and Conditions

- Quote Validity — Estimates remain open for 30 calendar days.

- Disputed Charges — Must be reported in writing within 5 business days; undisputed sums remain payable.
- Title and Risk — Title transfers only upon full payment; risk transfers at substantial completion.
- Lien and Collection — Contractor may file a lien, engage collections, and recover all reasonable costs, including legal fees.

- Severability — Invalidity of any clause does not affect the remainder of the Terms.
6. Additional Protective Clauses
- Limitation of Liability — Contractor’s total liability shall not exceed the lesser of the contract price or CAD $50,000, except for liability that cannot be limited by law and except for the TruProtect Cable Coverage recovery limit stated on the estimate under Section 2.2, which applies as written.

- Assignment — Customer may not assign rights without Contractor’s prior written consent.
- Privacy — Customer data is collected and used solely to perform the Agreement and comply with legal obligations; data is stored securely and not sold.
- Entire Agreement — The Agreement supersedes all prior proposals, discussions, and representations, oral or written.

- Appointment Cancellation Fee — A CA $79 fee applies to any Customer who cancels or denies access with less than 24 hours’ notice of a scheduled appointment, whether or not the Customer is a Member.
